The bill “On amendments to article 196 of the Family Code of Ukraine (re imposing special form of liability, which lies in compulsory labour on vacant work places that do not require special education or training, on a person that neither does aliment, nor works and is involved in debts for aliments and to transfer salary for this work on the current account of state institution, a trustee, or legal representative of a child) (Reg. No. 2806) aims at refining legislation concerning regulation of family relations in the part of parents’ duty to maintain their children of tender years (minor children). It is suggested supplement article 196 of the Family Code with a provision, under which, special form of liability, which lies in compulsory labour on vacant work places that do not require special education or training, is imposed on a person who neither does aliment, nor works and due to the fault of which the debt has arisen. Salary for such work is transferred on the current account of a trustee, legal representative of a child. State Employment Centers are obliged to employ the abovementioned persons, who by the decision of a court have to aliment.
Parliament members believe that the provision of the bill regarding transferring the whole amount of salary for compulsory labour to the current account of state institution, trustee, or legal representative of a child does not correspond to part three of article 22 of the Constitution of Ukraine.
